Brewer Police Chief Jason Moffitt is back on duty from administrative leave after fatally shooting a man.
Moffitt fatally shot Barry Chick Jr., 39, on March 22 on Green Point Road near the city’s public works building.
Moffitt was placed on administrative leave following the shooting, which is standard procedure. He returned to work Friday after an internal review, as well as an external review by an incident review team, Deputy Chief Christopher Martin said Wednesday.
The reviews found no evidence of wrongdoing or policy infractions that would lead to Moffitt remaining on leave, Martin said. The city of Brewer was briefed about the results.
As part of standard protocol, Moffitt had mental health reviews, Martin said.
There is no video footage of the moment of the shooting, Jonathan Bolton, public access officer for the Maine attorney’s general office, said previously.
The office is investigating the fatal shooting. The attorney general’s office has 180 days to investigate deadly force and determine if the force was justified or not, according to Maine law. A report explaining the decision will be issued at that time.
Chick allegedly attempted to rob the Brewer Walmart and escaped from staff who tried to detain him. He fled through the woods, leading to a police chase, Brewer police said previously.
Moffitt found Chick and “issued commands” to him, which he did not follow, police said. Chick appeared to reach for a weapon, and Moffitt fatally shot him, police said.
Moffitt became the Brewer public safety director in 2016, when the previous director retired.
