A Newcastle woman is appealing a federal court’s decision to dismiss her lawsuit alleging her child’s school violated her constitutional rights.
Amber Lavigne sued the Great Salt Bay Community School Board in 2023, saying her rights to “control and direct” her child’s life were violated after school staff provided the student a chest binder and used the child’s preferred name and pronouns.
She filed a notice to appeal Monday in U.S. District Court in Portland, asking the First Circuit Court of Appeals to reconsider the case, according to court records.
The lawsuit was dismissed May 3 by U.S. District Judge Jon Levy because it failed to state a claim, according to court records.
Lavigne alleged the school had an unwritten “withholding policy” to keep information from parents when a child may be transgender.
