The man who was shot on Hogan Road in Bangor Tuesday night was walking back to his hotel after dinner with a coworker when a passing driver allegedly shot him, an assistant district attorney said in court Wednesday.
The alleged shooter, Martavious Moore, 30, of Collins, Mississippi, is charged with elevated aggravated assault, reckless conduct with a dangerous weapon, refusal to submit to arrest and disorderly conduct. The felony charges will go before a grand jury.
New details of the shooting came out during Moore’s first court appearance at the Penobscot Judicial Center on Wednesday. Moore is accused of shooting the man around 9 p.m. Tuesday outside Bangor Inn and Suites at 701 Hogan Road.
The victim was shot in the head and neck area and is in stable condition, Assistant District Attorney Mercedes Gurney said.
The victim and a coworker were walking from Miguel’s Mexican Restaurant to the Bangor Inn and Suites, which are roughly 350 feet apart, when they crossed a road and a driver in a silver sedan yelled at them, Gurney said.
That driver, alleged to be Moore, exchanged words with the victim, who then approached the silver sedan. The victim then walked alongside the vehicle and appeared to throw a punch, Moore’s defense attorney said. Video footage from the Bangor Inn and Suites then shows the victim falling to the ground before the sedan drove away.
Moore didn’t know the person who approached his car after dark in the middle of the road and acted in self-defense, his lawyer said. Moore chose not to speed away so he did not cause injury to the person.
After the shooting, Moore went into his hotel room and refused to engage with police. The special response team went to the scene and Moore left the room after 4 a.m. Wednesday, police said previously. A handgun allegedly used in the shooting and a rifle were found in the room.
Moore has lived in Maine for two years installing solar panels. He was staying at the Bangor Inn and Suites for work, as were the victim and his coworker, lawyers said.
The silver sedan is registered to Moore and police found a spent shell casing on the driver’s seat, Gurney said.
Judge Jon Haddow set a $25,000 cash bail and Moore is in the Penobscot County Jail. His next court date is scheduled for Dec. 10.
