A lawsuit brought by a now-deceased conservative activist against a Hampden-area school department has been dismissed.
Shawn McBreairty sued Regional School Unit 22’s board and board chair Heath Miller in March 2023 in U.S. District Court in Bangor, alleging McBreairty’s right to free speech was limited.
McBreairty died June 3. No substitute for his role as plaintiff was filed in the lawsuit, leading to a judge dismissing the case Tuesday, according to court records.
The school board banned McBreairty from its meetings. Miller had police escort McBreairty out of a March 2023 meeting and cut the streaming feed, according to the lawsuit.
A different lawsuit brought by McBreairty against Brewer schools will be continued by his widow.
